Terms of service

§1 Definitions

For the purposes of these Regulations, the following definitions are adopted:

Seller - Natalia Pietrzykowska, an entrepreneur conducting business activity under the name BOA Palace Natalia Pietrzykowska, entered into the Central Register and Information on Economic Activity kept by the minister responsible for economic affairs and maintaining the Central Register and Information on

Economic Activity, NIP 7272864882, REGON number 523871572, ul. Więckowskiego 97/14, 90-757 Łódź.

  • Store - online store run by the Seller, available at www.boapalace.com.

  • Customer - a natural person, legal person or organizational unit with full legal

           capacity, who makes purchases in the Store.

  • Consumer – a natural person who makes purchases in the Store for purposes

           not directly related to their business or professional activity, in accordance with

           Art. 22 [1] of the Civil Code.

  • Basket – functionality of the Store that allows the Customer to add selected

          Products to one order and preview its contents before making a purchase.

  • Order – a declaration of will of the Customer submitted via the Store, leading

          directly to the conclusion of a sales agreement with the Seller.

  • Sales agreement – a distance contract between the Customer and the Seller,

          under which the Seller undertakes to transfer ownership of the Product to the

          Customer and issue it to him/her, and the Customer undertakes to pay the price

of
 the Product.

  • Account – an individual panel in the Store, available after registration and

          logging in, enabling the Customer, among other things, to review order history

          and edit data.

  • Registration form – a form available on the Store's website that allows the

          Customer to create an Account by providing data necessary to process orders.

  • Order form – a form available on the Store's website, used to place an order for

          Products.

  • Working days – days from Monday to Friday, excluding public holidays.

  • Order Fulfillment Time – the time needed to complete and ship the order,

          counted from the moment the Seller confirms the order.

  • Privacy Policy – a document specifying the principles of processing and

          protecting the personal data of Customers by the Seller, in accordance with

          applicable law.

  • Regulations – this document regulating the principles of using the Store and

          providing services by the Seller.

  • Newsletter – a free service provided by the Seller via e-mail, to which the

          Customer can sign up in order to receive information about promotions, new

          products and other events in the Store.

  • Cookies – text files saved on the Store user's end device, storing data needed

           for the proper functioning of the Store and analysis of its use.

  • Payment – the act of the Customer settling the amount due for the ordered

          Products, made via available payment methods, such as bank transfer, online

          payment or cash on delivery.

  • Delivery – the act of delivering the ordered Product to the Customer via the

          delivery method chosen by them, specified in the order form.


§ 2 Contact with the seller

6. The cost of a telephone call or data transmission made by the Buyer results from the basic tariff of the telecommunications operator or internet service provider whose services the Buyer uses. The Seller points out that the cost of an international call or international data transmission may be higher than the cost of a domestic call or transmission - depending on the tariff adopted by the telecommunications operator or internet service provider whose services the Buyer uses.

§3 Placing Orders

1.The Customer may place orders in the Store 24 hours a day, 7 days a week.

2.The prices of products visible in the Store are the total prices for the product.

3.To place an order, the Customer selects the Product, adds it to the basket, and then completes the order form, providing the data necessary for its execution. The order is placed when its content is confirmed and the Regulations are accepted by the Buyer.

4.After placing the order, the Customer receives an e-mail confirming that the order has been accepted for execution.

5.The Sales Agreement is concluded when the Customer receives the order confirmation.

6.The Buyer may register in the Store, i.e. create an Account there, or make purchases without registration by providing their data with each possible order.

7.The Seller has the right to refuse to accept an order, limit the method of payment or demand prepayment if the order raises reasonable doubts as to the truthfulness and reliability of the data provided or the method of payment, as well as if the execution of the order could expose the Seller to administrative, civil or criminal liability or threaten it with damage (including damage to its image).


§4 Prices and Payment Methods

1.The prices of products given on the Store's website are expressed in Polish zloty (PLN), dollars (USD) or euro (EUR) and include VAT.

2.The price of the individual item displayed on the Seller's website at the time the Buyer places the order is binding on the parties to the transaction. The price of the goods does not include the costs of its delivery, and information on the cost of delivery of the goods is provided when placing the order.

3.The Customer can make payment:

by bank transfer

by payment card: Visa, MasterCard, American Express, Apple Pay,google pay,Shop Pay, Maestro, UnionPay, Bancontact, iDeal

using integrated payment systems: Stripe, PayPal, blik,klarna all integrated with Shopify Payments

upon receipt of the parcel (if this option is available).

4. The Seller reserves the right to change the prices of Products and organize promotions and sales. The price change does not affect orders placed before the date of the change.

5. When purchasing each product, an invoice is issued in the form of a receipt or VAT invoice - depending on the product purchased.


§5 Order Fulfillment and Delivery

1.Products are delivered to the address indicated by the Customer in the order.

2.The order fulfillment deadline is indicated in the Store.

3.If the Buyer has chosen to pay in advance for the order, the Seller will start fulfilling the order after it has been paid for.

4.If the Buyer has purchased products with different fulfillment times within one order, the order will be fulfilled on the date appropriate for the product with the longest fulfillment time.

5.Delivery costs depend on the selected form of delivery and are presented to the Customer before the order is confirmed.

6.The BOA PALACE store offers shipping of orders both within Poland and to European Union countries and selected countries outside the EU.

7.The costs and time of international delivery may vary depending on the destination country and will be indicated in the ordering process.

8.If shipping to a given country is not possible, the Seller will inform the Customer about the impossibility of fulfilling the order in this direction.

9.The Seller is not responsible for delays in delivery resulting from the fault of the courier company or Poczta Polska.

10.The following delivery methods are available in the Store:

via a courier company mentioned in Shipping Policy

to Parcel lockers mentioned in Shipping Policy

via Poczta Polska

electronically, to the e-mail address provided by the Buyer when placing the order - in the case of Digital Content.


§6 Right to Withdraw from the Agreement

1. The Consumer has the right to withdraw from the Sales Agreement within 60 days from the date of receipt of the order.

2. To exercise the right of withdrawal, the Consumer should send a statement by filling the form or by letter to the Seller's address.

3. The return of goods is at the Consumer's expense, and the Product cannot bear traces of use.

4. The Seller undertakes to return the payment within 14 days of receiving the returned Product.

5. The privileged Buyer may use the model withdrawal form placed at the end of the Regulations, but this is not obligatory.

6. The Seller will return the payment using the same payment methods that were used by the privileged Buyer in the original transaction, unless the privileged Buyer agrees to a different solution; in each case, the privileged Buyer will not incur any fees in connection with this return.

7. In the event of the need to return funds for a transaction made by the privileged Buyer with a payment card, the Seller will return the funds to the bank account assigned to that payment card.


§7 Complaints and Warranty

1. The Seller is responsible for defects in Products under warranty, in according to the provisions of the Civil Code.

2. Complaints can be submitted by e-mail or by letter to the Seller's address,providing the Customer’s data, a description of the Product defect and a request regarding the method of its consideration.

3. The complaint will be considered within 14 days of its receipt. If the a complaint is accepted, the Seller will take appropriate corrective measures.

4. The shipping costs associated with accepting the complaint are borne by the Seller.

5. A physical defect consists in the non-conformity of the sold item with the Agreement. In particular, the sold item is non-conforming with the Agreement if:

a) it does not have the properties that such a thing should have, due to the purpose specified in the agreement or resulting from the circumstances or intended use;

b) it does not have the properties of which the Seller assured the Buyer, including by presenting a sample or model;

c) it is not suitable for the purpose of which the Buyer informed the Seller at the conclusion of the Agreement, and the Seller did not raise any objection to such intended use;

d) was issued to the Buyer in an incomplete state.

6. If the goods are defective, the Buyer who is a consumer may:

a) submit a declaration of withdrawal from the Agreement,

b) request the exchange of the product for a defect-free one,

c) request the removal of the defect.

7. The Seller may refuse to satisfy the Buyer's request if bringing the defective item into compliance with the Agreement in the manner chosen by the Buyer who is a consumer is impossible or, in comparison with the second possible method of bringing the item into compliance with the Agreement, requires excessive costs.

8. Returns are not subject to products made of 585 (14K) gold on order and individual orders, the subject of which is non-prefabricated goods, manufactured according to the specifications of the privileged Buyer or serving to meet their individual needs;


§8 Personal Data Protection

1.The administrator of personal data provided by the Buyer when using the Store is the Seller. Detailed information on the processing of personal data by the Seller - including other purposes and grounds for data processing, as well as recipients of data - can be found in the privacy policy available in the Store - due to the principle of transparency, included in the general regulation of the European Parliament and of the Council (EU) on data protection - „GDPR”.

2. The basis for the processing of personal data in this case is:

  • The contract or actions taken at the request of the Buyer aimed at its conclusion (Article 6(1)(b) GDPR),

  • The legal obligation of the Seller related to accounting (Article 6(1)(c) GDPR), and

  • The legitimate interest of the Seller, consisting in processing data for the purpose of establishing, pursuing, or defending potential claims (Article 6(1)(f) GDPR).

3. Providing data by the Buyer is voluntary, but at the same time necessary to conclude the contract. Failure to provide data will prevent the conclusion of the contract in the Store.

4. Personal data are processed for the purpose of fulfilling orders, servicing the Customer's account, as well as direct marketing of the Seller's own products and services, with the Customer's consent.

5. Personal data is stored for the period necessary to complete the order and provide after-sales service, as well as for the period required by law.

6. At any time, the Buyer has the right to access, correct and delete their personal data. In order to exercise these rights, the user may contact the store administrator by sending an e-mail to the following address:

§9 U.S. COMPLIANCE REQUIREMENTS

    • Any testimonials or endorsements on our site reflect real experiences and comply with FTC guidelines.

  • (B) California Consumer Privacy Act (CCPA) Compliance

    • California residents have the right to request access to, delete, or opt out of the sale of their personal information.

    • We comply with U.S. state sales tax laws.

§10 GOVERNING LAW & DISPUTE RESOLUTION

  • For EU/Polish customers: These Terms are governed by Polish law.

  • For U.S. customers: These Terms are governed by the laws of the State of Delaware.

  • Any disputes shall be resolved through arbitration, unless prohibited by law.


§11 Cookies

1. The Store uses cookies to adapt the content to the Customer's needs, analyze website traffic and conduct marketing activities.

2. Cookies may be disabled by the Customer in the browser settings. However, limiting the use of cookies may affect some functionalities of the Store.


§12 Final Provisions

1. The Regulations are an integral part of the Sales Agreement concluded with the Customer.

2. The Seller reserves the right to make changes to the Regulations for important legal or organizational reasons. Customers will be informed of the changes by e-mail or via the Store's website at least 14 days before they come into effect.

3. In matters not regulated by these Regulations, the provisions of Polish law shall apply, including the Civil Code and the Consumer Rights Act.

4. The Buyer is prohibited from providing content of an illegal nature.

5. Each order placed in the Store constitutes a separate agreement and requires separate acceptance of the Regulations. The agreement is concluded for the time and for the purpose of fulfilling the order.

6. All agreements concluded on the basis of these Regulations are subject to the provisions of Polish law, subject to paragraph 4.

7. The choice of Polish law for contracts concluded on the basis of the Regulations with the Consumer does not waive or limit the rights of this Buyer, which are granted to him on the basis of mandatory provisions of law, which are applicable to the Consumer in situations where there is no choice of law. This means in particular that if the national regulations applicable to a given Consumer provide for broader protection than that resulting from these Regulations or Polish law - this broader protection shall apply.
